Decree no. 2020-1609 of 17 December 2020 relating to energy performance diagnostics and the display of information relating to the energy consumption of dwellings in advertisements and property leases, JORF no. 0305 of 18 December 2020, Text no. 40,

Purpose: revision of the regulatory provisions relating to the establishment and use of energy performance diagnostics, the display of information in property advertisements and leases and the use of diagnostics data.

Entry into force: the provisions of the decree come into force on 1 July 2021 with the exception of the provisions relating to the observatory for energy performance diagnostics (12° of article 1) which come into force the day after the publication of this decree, the provisions relating to property advertisements and leases of 10°, 11° of article 1 and articles 2 and 3 which come into force on 1 January 2022 and the provisions of article 4 which come into force on 1 January 2028 .

Note: the decree revises the regulatory part of the French building and housing code governing energy performance diagnostics in order to take into account the full enforceability of these diagnostics, the date of which is set for 1 July 2021. It lays down provisions relating to the establishment of diagnoses, particularly in collective housing buildings, and their content. It incorporates the new obligations instituted by Act no. 2019-1147 of 8 November 2019 on energy and the climate concerning the posting in real estate announcements of the estimated theoretical energy expenditure and future obligations relating to housing with excessive energy consumption.
