The title of notary lawyer was conferred on each of the above by a decree of the French Minster of Justice (13 Place Vendôme, Paris), which can be consulted in the Official Gazette of the French Republic (JORF, see www.legifrance.gouv.fr).
Each of them is registered on the roll of notary lawyers at the Paris branch of the French Interdepartmental Chamber of Notary Lawyers (12 Avenue Victoria, 75001 Paris).
The professional activity of each of the firm’s notary lawyers is covered by a professional liability insurance policy taken out with Mutuelle du Mans Assurances (Independent Professions Department, 14 Boulevard Marie and Alexandre Oyon, 72030 Le Mans Cedex 9 ) for a sum of €100 million per claim with no geographical limitation, and in excess of this sum by Caisse Régionale de Garantie des Notaires – Paris 1 of 12 Avenue Victoria, 75001 Paris.

Complaints against one of the firm’s notary lawyers where no solution can be found, or claims for compensation, should be made in writing to the claims department of the Paris branch of the French Interdepartmental Chamber of Notary Lawyers (12 Avenue Victoria, 75001 Paris), including a detailed memorandum and a copy of any documents relevant to the understanding of the matter (Article 4 Section 4 of French Order No. 45-2590 of 2 November 1945).
The activity of notary lawyers is primarily governed by Order No. 45-2590 of 2 November 1945, Decree No. 45-0117 of 19 December 1945, Decree No. 71-941 of 26 November 1971, Decree No. 71-942 of 26 November 1971, Decree No. 73-1202 of 28 December 1973, Decree No. 78-262 of 8 April 1978, the French national regulations on notary lawyers, the French inter-court regulations on notary lawyers and the Compagnie de Paris regulations on notary lawyers.

On 16 April, the notarial profession launched a notary lawyer mediator website (in French) under the name mediateur-notariat.notaires.fr to enable clients who are experiencing difficulties with their notary lawyer to refer the matter to the Mediator of the Notarial Profession. This is an alternative to referring it to the relevant Chamber for the notary lawyer in question.
The remit of the Mediator of the Notarial Profession covers the full scope of a notary lawyer’s work, regulated or otherwise, whether the notary lawyer is subject to rate regulation or otherwise, and whether the matter arises from contractual liability or negligence. Excluded from this are complaints “of a purely ethical nature”, without claims for compensation or which are likely to bring about disciplinary proceedings.
Mediation is free of charge, both for the client and the notary lawyer in question.
The mediation process is confidential. Anything revealed there may not be used thereafter, in particular in the event of court proceedings regarding professional liability should the mediation break down or fail to achieve a solution.
The mediator is fully independent of the profession, and as such is appointed irrevocably for a period of at least three years from the time that his or her appointment is approved.
The legal basis for this new position is Order No. 2015-1033 of 20 August 2015 (stemming from a European Directive dated 21 May 2013), which creates the right for the consumer to have access free of charge to a mediator to resolve a dispute with a member of a profession. The aim of these regulations is to enable both the client and their notary lawyer to attempt to come to an agreement, with the help of a mediator and at the sole behest of the client, without having to resort to lodging a complaint with that profession’s governing bodies.
Christian Lefebvre took on the role of Consumer Mediator for the Notarial Profession on 16 February 2018 for a period of three years.
