Publication of decree n° 2020-412 of 8 April 2020: Prefects’ right of derogation

By Decree No. 2020-412 of 8 April 2020, published in the Official Gazette of 9 April 2020, the Government perpetuated the right of prefects to derogate, under certain conditions, from national standards, in order to simplify the law.

Construction, housing and town planning are among the matters open to the exercise of the prefectoral power of derogation.

Decree No. 2020-412 of 8 April 2020 on the right of derogation granted to the prefect, extract: (…) Article 1 The regional or departmental prefect may derogate from standards set by the State administration in order to take non-regulatory decisions falling within his competence in the following matters: 1° Subsidies, financial assistance and support measures in favour of economic actors, associations and local authorities; 2° Regional planning and urban policy; 3° Environment, agriculture and forests; 4° Construction, housing and urban planning; 5° Employment and economic activity; 6° Protection and development of cultural heritage; 7° Sports, socio-educational and associative activities (…)
